ICE agent David Gonzalez III appeared in a Fresno County courtroom Wednesday morning and pleaded not guilty to charges related to an alleged off-duty assault of a homeowner and his daughter in the Tower District.

Gonzalez, 32, was handcuffed to a wheelchair and wearing a red jail jumpsuit during his appearance. Brian Andritch — Gonzalez’s attorney — asked that his client’s face not be photographed or recorded by in-court reporters, for his safety, which Judge Robert Mangano granted.

Gonzalez is due back in court for a pre-preliminary hearing on Oct. 20. Judge Mangano set Gonzalez’s bail at $37,000 — down from the original bail amount of $52,000.

If Gonzalez posts bail, Mangano says he must remain within the state.

The incident took place early Friday, Oct. 9, after a woman arrived to her home near Dudley Avenue and Broadway Street — part of Fresno’s Tower District — and found Gonzalez unconscious on the front lawn. She notified her 72-year-old father, the homeowner, who woke him up. Gonzalez is charged with then attacking the man.

Police say the homeowner’s daughter intervened. Gonzalez is accused of pushing her to the ground in response. The homeowner then shot Gonzalez once before the agent was arrested, police say.

A neighbor posted on social media that the agent was “belligerently drunk” and wearing a wristband from a nearby nightlife establishment, according to the online post.

On Tuesday, Gonzalez was formally charged with aggravated assault, vandalism, elder abuse and battery — three felonies and a misdemeanor, respectively. He faces a maximum of 4 years and 8 months in custody if he’s convicted, according to the Fresno County District Attorney’s Office.
